KTalkAAC ("the app," "the service") is an augmentative and alternative communication (AAC) tool that allows users to create symbol-based communication boards, share them with caregivers and support persons, and use text-to-speech to give voice to their selections. The service is operated by Joshua Chin ("we," "us," "our").
You must be 13 years of age or older to create an account. Accounts for children under 13 must be created and managed by a parent or legal guardian, who accepts these terms on the child's behalf. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You retain ownership of all content you upload or create in KTalkAAC, including communication board layouts, symbols, images, and profile data ("Your Content"). By using the service you grant us a limited, non-exclusive, royalty-free license to store and transmit Your Content solely for the purpose of providing and improving the service.
You are responsible for ensuring Your Content does not:
We do not sell or share Your Content with third parties for advertising purposes.
KTalkAAC allows you to share communication profiles with other registered users ("collaborators"). When you share a profile:
We are not responsible for how collaborators use profiles that you share with them.
You agree not to:
The KTalkAAC name, logo, app design, and underlying software are our intellectual property. You may not copy, modify, distribute, or create derivative works of the service without our written permission. Symbol images provided through third-party libraries (such as ARASAAC) remain subject to their respective licenses.
We strive to keep KTalkAAC available but cannot guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where possible. We are not liable for any loss or inconvenience caused by downtime or changes to the service.
KTalkAAC is provided "as is" without warranty of any kind. We do not warrant that the service will be error-free, secure, or meet your specific requirements. AAC tools are communication aids; they are not a substitute for professional speech-language therapy. We make no representations regarding the suitability of this service for any particular medical, therapeutic, or clinical purpose.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the service. Our total liability for any claim arising under these terms shall not exceed the amount you paid us in the twelve months preceding the claim (or $10 if you have not paid anything).
You may delete your account at any time from the app settings. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted from our servers within 30 days, except where we are required by law to retain it longer.
We may update these terms from time to time. When we make material changes we will notify you through the app or by email at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of California.
